  • To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • You acknowledge and agree that use of the Services is entirely at your own risk.

3. User Responsibility for Compliance

You are solely responsible for ensuring that your use of the Services complies with all applicable federal, state, and local laws, regulations, and industry standards, including but not limited to:

  • Telephone Consumer Protection Act (TCPA) requirements;
  • Laws and regulations governing the use of AI technologies;
  • Applicable rules regarding voice recording, monitoring, and call transcription;
  • Privacy laws and data protection obligations relating to customers, their end clients, and end users.

Any violation of these requirements is solely your responsibility.

4. Use of AI and Voice Technologies

The Services may include AI-generated responses, automated voice interactions, call recordings, or other machine-generated content.

  • You acknowledge that AI output may be incomplete, inaccurate, or inappropriate for certain use cases.
  • You agree not to rely solely on AI-generated content for legal, financial, medical, or compliance-related decisions.
  • You are responsible for obtaining all necessary consents, authorizations, or disclosures before recording or processing the voice or personal data of customers and end clients.

5. Privacy and Data Protection

You agree to use the Services in compliance with all applicable privacy and data protection laws, including those governing the collection, storage, processing, and sharing of customer and end-client information.
You are solely responsible for:

  • Informing your customers of any AI or voice recording use;
  • Providing opt-out mechanisms where required;
  • Maintaining security safeguards to protect sensitive data.

6. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising from or related to your use of the Services.
  • Our total liability, if any, shall not exceed the amount paid by you (if any) to access the Services in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Service provider, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, fines, penalties, costs, and expenses (including attorneys’ fees) arising out of or related to:
